What is the purpose of this contest?

To support education, specifically musical education programs through the Temecula Education Foundation charity. The Temecula Education Foundation is a non-profit corporation, organized under Section 501(c)(3) of the Internal Revenue Code. Donations are tax-deductible to the full extent allowed by law.


Where does the Money Raised go?

The Temecula Education Foundation will receive:

  • 100% of the proceeds of the on-site live auction.

  • 100% of the proceeds of the on-site silent auction.

  • 100% of the proceeds of the on-site raffle tickets sales.

  • 100% of donations submitted via WCMA Donations Page
  • 20% of the ticket sales sold by the charity.

  • Wilson Creek Winery will donate $1 for each alcoholic beverage sold on the evening of the Awards Ceremony.

 The remainder will go to contest vendors to cover the costs of promoting and holding the event.

 

Volunteers’ Role

The WCMA Standing Committee and Board of Directors, the celebrity judges and the music industry / TV personalities involved in the WCMA are volunteers who believe in supporting music education programs and are generously donating their time and energy to this fundraising effort.

 

Entry Fee

$25 per category submission plus a $4 processing charge. Entry fees and processing charges are non-refundable.

Who May Enter the WCMA Contest?

Anyone with a passion and talent for musical performance. From up-and-coming bands to solo acts, to old-timers seeking to promote their art. Amateur and professional artists may enter. You may enter for yourself or enter your favorite band – Surprise them! Minors under 18 welcome with parental consent. You may also donate to the contest’s charitable goals without submitting an entry.

We are looking for musical/performance talent and appreciate the artistry not simply because it fits a specific category/genre but rather due to the ability, passion, and marketability of the submitted work and contestant.

Can I enter more than one category or make multiple submissions?

Yes, but only one entry per category is allowed and one submission per entry is allowed. An entry fee will apply per submission.

 

Judging Process and Criteria

All paid submissions will be vetted by a team of music industry professionals. Three finalists from each category will be selected by the WCMA Standing Committee and Board of Directors and those three finalists from each category will be judged by our powerhouse team of celebrity music industry judges. A First Place Winner will be selected by our judges and awarded first place in each category. A single overall Winner will be selected by the judges and awarded the Grand Prize.

While musical preferences and tastes vary, our team of professionals will be looking for both subjective and objective measures of talent that are widely recognized as legitimate markers of performance ability and musical excellence, including:

Finalists (3 in each category), First Place Winners (1 in each category, selected from Finalists) and Grand Prize Winner (1).

Grand Prize Winner Will Receive:

  • $1,000 CASH

  • Four song recording EP @the Recording Farm

  • Professionally produced music video by Sebaz Productions

  • Opening Slot performing with a National Act

  • Radio Play Package, Media Coverage, and National Exposure

  • Finalists will be invited to attend the Awards Ceremony at Wilson Creek Winery on Nov 5th, 2017 and may be asked to perform live

  • Finalists will be added to Golden Crown Productions' Talent Roster

  • Finalists will be invited to perform at the So Cal Fair in October 2017

  • Finalists will receive air time on local radio stations

An audio recording of your best work is required, all other items are optional -- but submit them if you have them so the judges can get a good look at your band. You may upload a link or a file.

MINORS under 18 years old: Minors are welcome to participate and must have their parent/guardian or legal representative complete and submit an entry form on their behalf. If entering on behalf of a minor, you certify you are legally authorized to represent said minor and execute this entry form on the minor(s) behalf and agree to contest rules herein. See LEGAL information below for additional detail.

 

Licensing

By submitting an entry and/or any creative work you wish to enter into the Wine Country Music Awards (WCMA), you hereby grant to Golden Crown Productions and WCMA, for no additional compensation, a non-exclusive, perpetual license for the use of any submitted materials for event promotional purposes. Keeping It Fair - Contest Integrity – Independent Auditor

Judging ballot integrity for the WCMA is the responsibility of Attorney and Independent Auditor Brad Jefferson Landon, Esq. Brad’s legal firm, LANDON LAW focuses on family law and business law. Brad is also the front man and songwriter in local band, The Garage Sale Monsters, a Garage Revival / Alternative band. Brad also serves as the Chief Athletic Inspector for the California Amateur Mixed Martial Arts Organization where he plays a key role in the safe and fair regulation of all amateur MMA competitions throughout California.

 

Management Discretion Prevails

WCMA Board of Directors and Golden Crown Productions, LLC reserve the right to make changes and modifications to the rules for purposes of clarification or for any other reason. This means if we missed something in the rules, or see an opportunity for improvement, we reserve the right to modify the contest rules

 

Legal

CONDITIONS
It is a condition of your entry in the WCMA contest that you do not:

i. restrict or inhibit any other user from using and enjoying the Service;
ii. post, upload, perform, or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation, any images or other material depicting Nudity, as herein defined;
iii. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

You agree that you will not use the Service, including the information provided therein and all related equipment, networks and network devices (specifically including Internet access) for any unlawful purpose. WCMA, at its sole and absolute discretion, shall determine whether any information transmitted or received violates this provision. You may not use any Material in connection with the Site or other use that contains or is associated with information or content prohibited by this section.

By uploading files, inputting data, or engaging in any other form of communication (a "Communication") through the Service you are granting WCMA a royalty-free, irrevocable, perpetual, non-exclusive, unrestricted, worldwide license to (i) use, copy, sublicense, adapt, transmit, publicly perform, display, or create derivative works from any such Communication, and (ii) sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to such Communication. No Communication shall be subject to any obligation of confidence on the part of WCMA.

OWNERSHIP, COPYRIGHT, LICENSING
You retain ownership of the copyright and other intellectual property rights in the Content, including but not limited to your performance. However, You hereby grant to WCMA a perpetual, irrevocable, royalty free, worldwide license to use, publicly display, distribute, sublicense, modify and otherwise fully exploit any Content that you submit. WCMA may do any or all of the foregoing for any purpose necessary or relating to WCMA’s services, products or advertising. Any Content that you submit is deemed non-confidential, and WCMA shall be under no obligation to maintain the confidentiality of any information, in whatever form, contained in the Content.

You shall be solely responsible for the Content and the consequences of posting or publishing it. In connection with the Content, you affirm that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize WCMA to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Content to enable inclusion and use of the Content in the manner contemplated by the Site and this Agreement; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Content in the manner contemplated by this Site and this Agreement. WCMA has the right in its sole discretion to refuse to post Content for any reason, including, but not limited to, submitted Content that appears to contain material protected by intellectual property rights held by a third party.

You agree that WCMA is not responsible for any violations of any intellectual property rights in any Content that you submit. You understand that by using the Service that your Content will be publicly available to others and that WCMA has no obligation to prevent the unauthorized copying, dissemination, alternation or other use of your Content by others.

YOU AGREE THAT YOUR USE OF THE SITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WCMA AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SPONSORS, VOLUNTEERS AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WARRANTIES IMPLIED FROM A COURSE OF PERFORMANCE OR COURSE OF DEALING, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING ANY PARTICIPATION IN A CONTEST. IN NO EVENT SHALL WCMA OR ITS SPONSORS OR SUPPLIERS, BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SERVICE OR WITH THE DELAY OR INABILITY TO USE THE SERVICE OR PARTICIPATE IN THE CONTEST, OR FOR ANY INFORMATION, PRODUCTS AND SERVICES ADVERTISED IN OR OBTAINED THROUGH THE SERVICE, WCMA’S REMOVAL OR DELETION OF ANY MATERIALS OR RECORDS SUBMITTED OR POSTED ON THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WCMA OR ANY OF ITS SPONSORS OR SUPPLIERS, HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. THIS WAIVER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, FILE CORRUPTION, COMMUNICATION-LINE FAILURE, NETWORK OR SYSTEM OUTAGE, OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY FILE. LIMITATION OF ACTIONS

INDEMNIFICATION
You agree to defend, indemnify and hold harmless WCMA, its Sponsors, and their respective directors, officers, employees, volunteers and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (a) any material posted or otherwise provided by you that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by you in connection with your use of the Service; (c) any non-compliance by you with the terms and conditions of this Agreement; and (d) claims brought by persons or entities other than the parties to this Agreement arising from or related to your access and use of the Service, including the information obtained through the Service.

MINORS
If you have agreed to allow your minor child, or a child for whom you are legal guardian (a "Minor"), to use the Service, you agree that you shall be solely responsible for: (a) the online conduct of such Minor; (b) monitoring such Minor's access to and use of the Service; and (c) the consequences of any use of the Service by such Minor. Children under the age of 13 should not register for the Service. We ask for the age of the users. WCMA relies on our users to be truthful in responding to these questions. If a user does not identify his/her proper age, we will have no way of verifying actual age with respect to our privacy policy.

Pursuant to 47 U.S.C. Section 230(d) as amended, WCMA hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. INFRINGEMENT POLICY
WCMA, pursuant to 17 U.S.C. Section 512 as amended by Title II of the Digital Millennium Copyright Act (the "Act"), reserves the right, but not the obligation, to terminate your right to use the Service and remove material that are alleged to infringe the copyright or other intellectual property rights of a third party if WCMA determines in its sole and absolute discretion that you are involved in infringing activity, including alleged acts of first-time or repeat infringement, regardless of whether the material or activity is ultimately determined to be infringing. WCMA accommodates and does not interfere with standard technical measures used by copyright owners to protect their materials.
